Asbestos Businesses in Western Australia, Australia
Western Australia regulates asbestos under the Work Health and Safety Act 2020 and WHS (General) Regulations 2022. WorkSafe WA, part of the Department of Energy, Mines, Industry Regulation and Safety, is the state regulator. WA was one of the last states to adopt the national model WHS laws, with the new framework starting on 31 March 2022. It replaced the old Occupational Safety and Health Act 1984 and brought mining safety under the same regime for the first time.
The 2022 harmonisation was a big change for WA. It consolidated workplace safety across general industry, mining, and petroleum under one Act, where previously each had separate legislation. Separate WHS (Mines) Regulations 2022 apply specific asbestos requirements to mining operations, which matters given how large the resources sector is in WA. There were transitional arrangements giving businesses a year to adjust.
WA has a particular connection to asbestos through the Wittenoom mine in the Pilbara, which operated from 1943 to 1966 and is responsible for thousands of asbestos-related deaths. The town was officially degazetted in 2007. The state participates in the ASSEA National Strategic Plan 2024-2030, and its move to the national model WHS framework has made cross-jurisdictional consistency easier to achieve.
Licensing
WA follows the national model. Class A covers friable asbestos, Class B covers more than 10 square metres of non-friable. WorkSafe WA also issues Licensed Asbestos Assessor (LAA) credentials for people who do air monitoring and clearance inspections. The regulator runs a public licence search tool so anyone can verify a removalist's licence before hiring them.
